Article 1: General terms and conditions of sale
1.1. Purpose of the General Terms and Conditions
The present general conditions of sale apply without restriction or reserve to mail order and online sales of SCEA des Léotins products on the www.vignobles-lumeau.com website.
1.2. Scope of application
The General Terms and Conditions of Sale govern the contracts for mail-order and online sales of the Vendor’s products to purchasers (hereinafter referred to as “Customers”) and, together with the order form, constitute the contractual documents binding on the parties, to the exclusion of all other documents, brochures, catalogs or photographs of the products, which are for information purposes only.
The GCS apply exclusively to products delivered to customers.
The GTC, as well as all the information mentioned on the site, are written in French.
1.3. Availability and enforceability of terms and conditions
The GCS are available to customers on the seller’s website, where they can be consulted directly. In addition, they may be communicated to customers on request by telephone or post to the contact details given in article 16.
Confirmation of an order by the customer implies unreserved acceptance of the General Terms and Conditions of Sale in force on the day of the order, which the seller will keep and reproduce in accordance with applicable legislation.
1.4. Modification of the GTC
The seller reserves the right to unilaterally modify these GTC at any time.
In the event of modification of the present GTC, the applicable GTC are those in force on the date of the order, a copy of which dated to that date may be provided at the customer’s request.
1.5. Terms and conditions
The nullity of a contractual clause does not entail the nullity of the GCS.
The temporary or permanent non-application of one or more clauses of the GTCS by the seller shall not constitute a waiver of the other clauses of the GTCS, which shall remain in full force and effect.
Article 2: Products
2.1. Product features
The products offered for sale are each described in terms of their essential characteristics within the meaning of article L.111-1 of the French Consumer Code. The photographs illustrating the products do not constitute a contractual document.
Bottles of wine make up the bulk of the products on offer. The customer is hereby informed of the sensitivity of this type of product to variations in temperature and humidity.
2.2. Product conformity
The seller certifies that the products comply with the regulations in force relating to personal health and safety, fair trading and consumer protection at the time they are placed on the market.
2.3. Product availability
In principle, the properties listed are available. Nevertheless, in the event of unavailability of the goods ordered, the customer will be informed of this unavailability as soon as possible.
Article 3: Orders
3.1. Contract conclusion stages
It is up to the customer to select the different types of products they wish to order by filling in their virtual basket and specifying the desired quantities.
Confirmation of the order implies full acceptance of the GCS by the customer.
Once the order has been confirmed on the site, the customer must pay for the order via the secure interface provided on the site.
An e-mail confirming the order and payment will be sent to the customer as soon as possible after payment has been received.
3.2. Order modification
Any modification of the order by the customer after payment is subject to the seller’s agreement.
In addition, the seller reserves the right to modify the product ordered in line with technical developments, in accordance with article R132-2-1 of the French Consumer Code.
Article 4: Rates – Payment
4.1. Rates
Products are supplied at the current prices shown on the site when the order is registered by the Vendor. Prices are given in euros and exclude VAT.
These rates are firm and non-revisable during their period of validity as indicated on the site. They do not include shipping costs, which are charged extra.
4.2. Payments
The payment of the totality of the price after confirmation of the order by the customer and payable cash the day of the placing of the order and is made by bank card, by secure payment Paypal.
Article 5: Deliveries
5.1. Delivery charges
The seller requires a contribution from the customer towards delivery costs. These vary according to the number of bottles.
5.2. Delivery time
The maximum delivery time is 20 days from the conclusion of the contract.
5.3. Delivery address
The delivery address is the one indicated by the customer when placing the order. If the delivery address changes, the customer must indicate this when placing the order.
Article 6: Transfer of ownership – Transfer of risks
The transfer of ownership of the related products takes place after full payment of the price by the Customer, regardless of the delivery date.
The transfer of risk from the Vendor to the Customer occurs at the time of delivery to the address indicated by the Customer.
Article 7: Right of withdrawal
From the date of receipt of the products, the customer has a 14-day cooling-off period to return the delivered products without having to justify himself or pay any penalty, to the following address indicated in article 16.
Return shipping costs are at the consumer’s expense.
The sums paid by the customer, including delivery costs, will be reimbursed in full by bank transfer to the account indicated for this purpose by the customer or by cheque within a maximum period of 14 days from the exercise of the right of withdrawal, provided that the products returned are in their original packaging, complete, in perfect condition and accompanied by the original purchase invoice.
To exercise the right of withdrawal, you must notify us of your decision to withdraw by means of an unambiguous statement (e.g. letter sent by post, e-mail).
Article 8: Seller’s liability – Warranty
The products offered comply with current French legislation. SCEA Des Léotins shall not be held liable in the event of non-compliance with the legislation of the country where the product is delivered. It is your responsibility to check with local authorities about the possibility of importing or using the products you intend to order.
Article 9: Personal data
SCEA Des Léotins reserves the right to collect personal information about you. They are necessary for the management of your order.
They will be transmitted to the transport company that will deliver your order.
This information and data is also stored for security purposes, in order to comply with legal and regulatory obligations.
You have the right to access, rectify and object to nominative information and personal data concerning you.
Article 10: Regulations governing the sale of alcohol
Article L3342-1 of the French Public Health Code prohibits the sale of alcohol to minors under 18. By placing your order, you agree to be at least 18 years old on the date of the order.
Alcohol abuse is dangerous for your health. It should be consumed in moderation.
